Using it as an apology
It explains; it does not apologise. Telling a manager 仕方がありませんでした about your own missed deadline says “nothing could have been done,” which is a defence, not a sorry. The apology is 申し訳ありません, and it comes first.
Saying it back to someone's bad news
仕方がないですね in response to somebody's trouble can land as “well, tough.” If you mean sympathy, say 大変でしたね. Context matters: 仕方がない can also reassure someone that an unavoidable problem was not their fault.
Reading 〜ても仕方がない as the plain phrase
